Terms of Service

These Terms address platform users and bookings. For business subscriptions, see our Business Terms and Data Processing Agreement. Company details are in our Legal Notice.

1. Acceptance of Terms

By accessing and using Naayya, you agree to be bound by these Terms of Service and all applicable laws and regulations.

2. Booking Services

Naayya provides software that connects customers with businesses offering classes, appointments and other services. The business providing a booked service is responsible for that service. By making a booking, you agree to:

  • Provide accurate and complete information
  • Pay all fees associated with your booking
  • Comply with cancellation policies
  • Follow business rules and guidelines

Some businesses using Naayya may require a verified phone number to complete booking-related flows. For details on how booking, contact, and phone data are handled, please review our Privacy Policy.

3. Cancellation Policy

Please review our cancellation policy carefully:

  • The business providing the service sets its cancellation, rescheduling, refund and no-show conditions.
  • Review the applicable conditions shown during booking or otherwise provided by the business before purchase.
  • Nothing in these Terms limits your rights under applicable consumer law.

4. Analytics and Data Collection

By creating an account and using Naayya, you acknowledge that Naayya processes service and security data needed to operate, secure, and troubleshoot the platform, subject to applicable privacy laws.

  • Operational telemetry: We process technical telemetry required for fraud prevention, abuse detection, troubleshooting, account security, bookings, payments, and platform reliability.
  • Product analytics on signed-in surfaces: On signed-in product surfaces, we process product analytics to improve the service. The scope, use of browser storage, legal basis and controls are described in our Privacy Policy. You can object at any time from Account Settings. See our Privacy Policy Section 15.2 for details.
  • Marketing analytics and advertising: On public pages, we may use analytics or advertising technologies that rely on cookies. These are governed by our cookie consent controls and applicable consent requirements, not by acceptance of these Terms alone.
  • Consent requirements: Where local law requires consent for non-essential analytics cookies, advertising technologies, or similar browser identifiers, we collect and honor those consent choices separately on our website and browser-based flows.
  • No bundled consent: On our website and browser-based flows, creating an account, logging in, or accepting these Terms does not by itself grant consent for optional marketing analytics or advertising where consent is required by law.
  • Account deletion impact: When account deletion is completed, we remove access credentials and run de-identification/deletion workflows across relevant systems, while retaining records required by law (for example tax/accounting and fraud-prevention records).

5. Account Responsibilities

As a registered user, you are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

6. Intellectual Property

All content, features, and functionality on Naayya are owned by Naayya S.A.R.L.-S and are protected by international copyright, trademark, and other intellectual property laws.

7. Limitation of Liability

To the extent permitted by applicable law, Naayya excludes liability for indirect or consequential loss arising from use of the platform. This does not exclude or limit liability that cannot lawfully be excluded or limited, or mandatory consumer rights. Business subscriptions are governed by the separately agreed Business Terms.

8. Email Communications and Newsletters

By creating an account on Naayya, including as a business owner, manager, or teacher, you agree that we may send service-related email communications needed to operate and secure your account. Optional marketing, product updates, educational content, and our weekly editorial newsletterThe Signal by Naayya are sent on a separate basis permitted by applicable law, such as explicit consent or soft opt-in where applicable. Creating an account or accepting these Terms alone does not create documented consent for optional marketing or newsletter communications.

You may opt out of any non-essential category at any time using the unsubscribe link included in every email or via your account email preferences. Opting out of marketing or newsletter emails does not affect transactional and security emails required to operate your account. 9. Changes to Terms

We may update these Terms and will communicate material changes with their effective date as required by applicable law. An update does not retrospectively change accrued rights or automatically override a separately signed business agreement.
